California Supreme Court Upheld Proposition 8, banning same sex marriages, but wisely allowed the 18,000 gay and lesbian couples who already joined to stay in marriage status. I don't know that they could do anything else. It was a 6 to 1 decision in keeping proposition 8.
The decision continues to allow gay couples to join and have all the legal rights as a married couple, but does not use the word marriage. The court's decision was based on the facts that the couples are not being denied any legal right that any married couple has.

I have to say I agree with this, most states when faced with a question about the constitution and rewriting the constitution most people stand with the constitution.
This is not speaking out against people who wish to have a same sex union, its about not wanting to change the constitution as our forefathers meant it to be.

Not shame on California, but shame on the California Supreme Court for making us have to go through this. They should have never created the right to have same-gender marriage in the first place. But, now they seem to have reconciled their misdeed somewhat.
Their ruling is the correct one this time.
It barely passed in the first place. So it will be re-voted as soon as a few more nasty homophobic bigots drop dead from old age, and it will be reversed by a democratic vote. In my lifetime there will be equal rights for gays all over America.

Yep, it very well could have been the "homophobic bigots" that created enough votes to exceed 50%. But, it was still quite shy of the two-thirds majority that should have been legally required to establish the right to homosexual marriage in the first place.

THE PEOPLE VOTED!!! Isn't that the important part....that all of us still have a say? Each state can decide for themselves what each state wants. Overturning prop 8 would show that it didn't matter what the people want and voted for, so why even bother voting.

The whole "marriage is between a man and a woman" argument is sanctioned by Christian orgnizations. I have yet to see a Jewish or Hindu organization come out with that statement.

Incidentally, homosexual marriage is not wrong for religious reasons. Rather, legitimate religions are opposed to it because it is wrong. This is an important principle and supersedes all established religion.

This is what bugs me (among other things) about this issue. If Christians don't want Gays to marry in their church <b>fine</b>. That doesn't mean other religions won't marry them.

The California Supreme Court has created an inequity by abolishing Proposition 8 for homosexual couples already married, but upholding it for all others.
Nonetheless, the ruling makes sense to me. I agree with it.
Interesting, though, I heard someone compare this to the end of slavery. There was no "grandfather clause" that allowed those who already owned slaves to continue owning them. But, that was the United States Constitution, not a state constitution - quite different.
I don't hate gays but think California made a good call. Gays are not excluded from any right that I enjoy so Prop 8 is a reasonable law by the people for the people.
Anyone with half a brain knows that Prop 8 failed due to the BS propaganda spewed by the religious right, as well as the heavy handed Mormon contingent. To say it passed fair and square is just plain inaccurate.

Jeff, gays are excluded from countless rights that you have: the right to serve openly in the military, the right not to be fired because of sexual orientation, the right to visit one's life partner in an intensive care unit, rights of property ownership, right to freedom from fear of property and and bodily harm by queer bashers, rights to some benefits after the death of a spouse, right to adopt and on and on. A major ritght gays do not have that straights have is to live freeof fear from the harm those of other sexual orientation inflict on them.
