Casey's ever diligent attorney, Jose Baez, had tried his best to keep the footage under wraps but his attempts failed. Baez claimed that because the footage was taken while his client was in a medical facility; releasing it would violate her medical privacy. In June 2009, the video was sealed to protect Casey's right to a fair trial. However, now that the Tot Mom has been found not guilty, "Judge Belvin Perry ruled that protecting Anthony's right to a fair trial was no longer an issue."
In dismissing Baez's concerns, Perry wrote, "There is no reasonable expectation of privacy in jail. The fact that she was sitting in a waiting area of the medical facility did not convert the incident into a medical evaluation and the fact that medical personnel had the opportunity to observe her while she watched the news coverage and gave her a sedative does not change this conclusion."
This video does little to sway Casey Anthony's supporters of her innocence or to sway her critics of her guilt. Overall, the footage can easily be explained in two ways: as a loving mother, Anthony was so distressed officers found the dead remains of Caylee that she became ill OR as a cold blooded selfish killer, Anthony was so stressed and worried officers had found the remains of Caylee that she became ill.
