Kyron Horman has been missing for two long excruciating years on June 4 of this year. The morbid anniversary means one thing for Kyron's biological mother Desiree Young--now she can go after the woman she believes is responsible for her son's disappearance. Terri Horman was Kyron's stepmother at the time and is the last person who saw the little boy.
Desiree filed the lawsuit as soon as the case reached the statute of limitations required for anybody alleging intentional damages. Part of the lawsuit states Terri, "intentionally interfered with [Young's] parental rights and that Terri Horman intentionally inflicted severe emotional distress." A civil case requires very little evidence to prove a person is responsible for damages.
Although Terri does not have to take the stand, failure to do so will likely hurt her chances of winning. If she does take the stand, there is a very good chance she may slip up and give investigators new information. Anything she says on the stand in the civil suit, can be used against her in criminal proceedings.
Desiree is also asking, "the return of her son and seeks compensatory damages." The mourning mother believes her suffering is worth at least $10 million. It is unlikely she would ever receive a penny of that amount if she wins the case, but it is one way to let Terri know Desiree is not giving up.
Terri has never been charged with kidnapping Kyron, but Desiree fully believes the ex-stepmother is responsible. Kyron Horman's case is still open. This latest move on Desiree's part is essentially a reminder to Terri, there is still a family waiting for their son to come home. It has been two years, and Terri is still a free woman. It is high time she gave Desiree some closure.
